Terms & Conditions

1. Acceptance of Terms
By accessing or using the Land & Legacy platform, website, or any associated programs or services ("Services"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our Services.
These Terms apply to all users including participants, guardians, mentors, school partners, farm partners, and visitors to our website.
2. About Land & Legacy
Land & Legacy Pty Ltd (ABN placeholder) is an Australian educational organisation delivering asset-based learning programs through agriculture, land stewardship, and creative expression. Our programs operate across partner farms and school environments throughout Australia.
3. Enrolment and Eligibility
Enrolment in Land & Legacy programs is subject to:
- Completion of an approved application and acceptance by Land & Legacy.
- Payment of applicable program fees (or approval of scholarship/financial aid).
- For participants under 18, submission of guardian consent and contact details.
- Compliance with all program rules, safety requirements, and farm host expectations.
4. Fees and Payments
Program fees are published on the Land & Legacy website and are subject to change. Fees must be paid in accordance with the agreed payment plan prior to program commencement unless a financial aid arrangement is in place.
Deposits, cancellations and refunds for bookable sessions, experiences and farm visits are governed by section 5 below. For multi-term program enrolments, participants who withdraw before the program start date may be eligible for a partial refund at Land & Legacy's discretion; no refund is provided for withdrawal after program commencement unless exceptional circumstances apply.
5. Cancellations, Deposits and Refunds
This section applies to all bookable sessions, experiences, workshops and farm visits, and is effective from 7 August 2026. Notice periods are counted in whole days before the scheduled session start time. Refunds are returned to the original payment method within 10 business days.
- Cancel 14+ days before. Full refund of everything you have paid, including any deposit.
- Cancel 7–13 days before. 50% refund of the fees paid. The deposit is not refunded in this window.
- Cancel less than 7 days before, or no-show. No refund is payable, though a credit may be offered at our discretion.
- Deposits. Where a deposit applies it is around 20% of the booking value, is applied to your total, and is refundable only if you cancel at least 14 days before the session.
- How long refunds take. Approved refunds are returned to the original payment method within 10 business days.
- Weather and unsafe conditions. If we cancel for weather, fire, flood, animal welfare or any other safety reason, you may transfer to another date or take a full refund. Sessions run in light rain, so dress for the conditions.
- Changes and transfers. You may transfer to another available date at no cost with at least 7 days notice, subject to availability. One transfer per booking.
- If we cancel. Where Land & Legacy cancels a session for any reason, you always receive a full refund or a transfer — your choice.
Individual experiences and partner farms may publish their own cancellation, deposit or weather terms. Where an offering states its own terms, those terms are shown on the booking page and apply to that booking in place of the standard windows above. Where an offering states nothing, the standard windows above apply.
Nothing in this section limits your rights under the Australian Consumer Law, including your right to a remedy where a service is not supplied with due care and skill. Requests to cancel must be made in writing to our contact address in section 12, and take effect from the time we receive them. Exceptional circumstances, including documented illness or bereavement, are considered on request regardless of the notice period.
5a. Late Cancellations and Non-Attendance
A cancellation made less than 7 days before a session, or a failure to attend a booked session, is treated as a late cancellation. No refund is payable, though a credit may be offered at our discretion. Places are held for you and staffing, insurance and animal-handling arrangements are committed in advance, which is why late notice cannot be refunded.
Repeated late cancellations or non-attendance may result in a requirement to pay in full at the time of booking for future sessions.
5b. Membership Discounts and School Fees
A school fee is any amount charged, collected, administered, invoiced or required by a school, educational institution, school authority, school partner or government education body as a condition of enrolment, attendance, participation, assessment, progression or access to school services. A charge remains a school fee where Land & Legacy collects it on behalf of the school.
Membership discounts apply only to eligible Land & Legacy services and approved partner offers identified at the time of booking. Membership discounts do not apply to school tuition, school enrolment fees, school registration fees, school levies, compulsory educational charges, curriculum fees, subject fees, technology fees, school transport, uniforms, meals, school camps charged by a school, examination fees, certification fees, government education charges, donations, taxes, deposits, booking fees or third-party pass-through costs.
Participation in a Land & Legacy activity through a school does not automatically create entitlement to a membership discount. Where a school contracts, administers or invoices the activity, the applicable school or institutional agreement determines the price.
Scholarships, sponsorships, bursaries, grants and school subsidies are separate from membership benefits and are subject to their own eligibility, approval and funding conditions.
6. Participant Conduct
All participants are expected to:
- Treat farm hosts, mentors, peers, and animals with respect and care.
- Follow all safety instructions provided by farm hosts and program staff.
- Comply with Land & Legacy's Child Safety Code of Conduct.
- Refrain from behaviour that is harmful, disruptive, or in breach of applicable laws.
Land & Legacy reserves the right to remove a participant from a program for serious or repeated breaches of conduct without refund.
7. Health, Safety, and Risk
Participation in agricultural and outdoor programs involves inherent risk. Land & Legacy takes all reasonable steps to mitigate risk, including partner farm compliance checks, risk assessments, and mentor supervision. However, participants and guardians acknowledge that some level of risk cannot be eliminated.
Participants must disclose any relevant health conditions, accessibility needs, or allergies at the time of enrolment. Land & Legacy cannot guarantee accommodations for conditions not disclosed.
8. Intellectual Property
All content on the Land & Legacy website and platform, including text, images, program materials, and design, is the property of Land & Legacy Pty Ltd and is protected by Australian copyright law. You may not reproduce, distribute, or adapt any content without prior written permission.
9. Limitation of Liability
To the extent permitted by Australian law, Land & Legacy's liability for any loss or damage arising from participation in our programs or use of our Services is limited to the fees paid by the participant for the relevant program term.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for any other liability that cannot be excluded under Australian Consumer Law.
10. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.
11. Changes to These Terms
Land & Legacy may update these Terms from time to time. Registered users will be notified of material changes by email. Continued use of the Services after notice constitutes acceptance of the updated Terms.
